1. About us and how these Terms work
In these Terms, references to the HEADTURNED Foundation or the Foundation mean the organisation responsible for this website and the projects it describes.
These Terms & Conditions (the Terms) set out the basis on which you may:
- access and use this website; and
- make donations or other contributions through this website.
By using this website, you agree to these Terms. If you do not agree, you should not use the website or submit donations through it.
2. Scope of these Terms
These Terms apply to the public-facing HEADTURNED Foundation website and the donation flows and contact routes made available through it.
A separate set of terms and policies will apply to the HEADTURNED PPV platform (including creators, subscribers and any services delivered through that platform). Those platform-specific terms will be published and agreed directly on the PPV platform when it goes live.
3. Other documents that also apply
These Terms should be read together with the following documents, which form part of the overall framework for how we operate:
- Our Privacy Notice, which explains how we collect and use personal information.
- Our Cookie Policy, which explains how we use cookies and similar technologies.
- Our Accessibility Statement, which explains our approach to accessible design.
- Relevant policies listed on our Policies hub, including (for example) Safeguarding, Data Protection & Information Governance, and Complaints & Feedback.
4. Using this website
You may use this website for lawful purposes only and in a way that is consistent with these Terms. In particular, you agree that you will not:
- use the website in any way that is unlawful, fraudulent, or likely to impair or damage the site;
- attempt to gain unauthorised access to any part of the site, our servers, or any connected systems;
- introduce viruses, malicious code, or other harmful material; or
- use any content on this site in a way that infringes our rights or the rights of others.
5. Information on this site
We aim to keep the information on this site accurate and up to date, but it is provided for general information only. It is not intended to amount to advice on which you should rely.
We may update or change the content from time to time to reflect new projects, policies, or decisions. We do not guarantee that the site, or any content on it, will always be available or free from errors or omissions.
6. Donations and payments
Where the website allows you to make donations or other payments to the Foundation:
- You confirm that you are authorised to use the payment method you provide.
- Donations are generally voluntary and non-refundable, unless we are required to refund them by law or choose to do so at our discretion.
- Where you direct a donation to a particular theme or project, we will endeavour to apply it accordingly, while retaining discretion to redirect funds if circumstances change and to ensure overall impact.
Any specific information about how donations are processed (for example, by a payment provider) will be explained at the point of payment.
7. Gift Aid and tax matters
Where Gift Aid or similar tax relief schemes are available, additional declarations may be required. It is your responsibility to ensure that any declaration you make is accurate and that you are eligible to make it.
The Foundation does not provide personal tax advice. If you are unsure about the tax treatment of a donation, you should seek independent advice.
8. Intellectual property rights
Unless stated otherwise, all content on this site – including text, images, logos, branding, and project information – is owned by or licensed to the Foundation and is protected by copyright and other intellectual property laws.
You may view, download, and print content from the site for your own personal, non-commercial use. You may not copy, reproduce, distribute, adapt, or use content for commercial purposes without our prior written permission from at least two current directors of the Foundation.
9. Third-party links and resources
This website may include links to third-party sites or resources. These are provided for information only. We have no control over the contents of those sites or resources and are not responsible for them.
10. Our responsibility to you
Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.
Subject to that, and to the fullest extent permitted by law, the Foundation will not be liable for:
- any loss or damage arising from your use of, or inability to use, this website; or
- any loss or damage arising from your reliance on any content displayed on this website.
We are not responsible for loss or damage that was not reasonably foreseeable when you began using the site.
11. Events outside our control
We are not responsible for any failure to perform, or delay in performing, any obligation under these Terms that is caused by events outside our reasonable control, such as failures of hosting providers, utilities, or communications networks.
12. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in law, guidance, or how the Foundation operates. When we do, we will update the version published on this page.
Your continued use of the website after changes are made will indicate that you accept the updated Terms.
13. Contacting us
If you have questions about these Terms, or would like to raise a concern, you can contact us using the details on our website, including our contact form.
Complaints and feedback will normally be handled under our Complaints & Feedback Policy.
14. Governing law and jurisdiction
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the United Kingdom (or, where applicable, a specific UK jurisdiction).
Any disputes arising in connection with these Terms will be subject to the jurisdiction of the courts of the United Kingdom, without prejudice to any rights you may have under mandatory local laws.
